What documents do I need to sell my property?

The basic documents required are: the title deed, the owner’s DNI or NIE, a simple extract from the Land Registry, the most recent IBI bill and an energy performance certificate. If the property is part of a housing community, you will also need a certificate confirming there are no outstanding debts to the community. What is building authorisation and when is it required?

This is the process of regularising buildings, renovations or extensions carried out without planning permission or which did not comply with the approved plans. It is necessary when you wish to sell, mortgage or transfer title to a property that has unauthorised building works. It also enables you to connect to utilities such as water, electricity or gas.

What is AFO and who is it for?

The ‘Asimilado Fuera de Ordenación’ (AFO) is a procedure that allows for the regularisation of older buildings —generally those over 10 years old— that lack planning permission or legal documentation. It is particularly common in rural areas of the region. We handle the entire process: technical survey, safety certificate, dealing with the local council and registration with the Land Registry.

What are the steps involved in the process of legalising a building project?

The process comprises four stages: first, the technical survey and preparation of plans of the work carried out; next, the issue of the certificate of structural safety and habitability; followed by the administrative procedures with the local council; and finally, the regularisation of the property’s registration through a notarial deed and entry in the Land Registry.

What legal procedures do you handle?

We handle all types of documents and procedures relating to property: drafting and reviewing contracts, deeds, powers of attorney and minutes; dealing with public registers, notaries, local councils and the tax authorities; and representing clients before administrative or judicial bodies where necessary.

Do you handle the administration of property estates?

Yes. We handle the entire process: acceptance of the inheritance, settlement of inheritance tax, signing of the deed before a notary and registration with the Land Registry. How long does it take to settle an inheritance?

The usual timeframe ranges from 3 to 6 months, depending on the complexity of the inheritance, the number of heirs and the registration status of the assets. There is a statutory deadline of 6 months from the date of death to settle inheritance tax, although it is possible to apply for an extension. We will support you throughout the process to ensure you meet the deadlines without any hitches.

Do you carry out valuations for inheritance or divorce cases?
